Guilty Until Proven Innocent: Border Patrol Discrimination in Southern NM

In our country we take for granted that we are presumed innocent until proven guilty. But in communities that span 100 miles north of the U.S.-Mexico border, the Border Patrol is flipping that presumption on its head. The ACLU of New Mexico Regional Center for Border Rights (RCBR) has conducted an investigation into the practices of the Border Patrol in southern New Mexico and found disturbing evidence that Border Patrol agents:

  • Abuse innocent residents who are doing nothing more than going about their daily lives.
  • Racially profile innocent border residents, making our communities less safe and sowing mistrust in the community.
  • Put the health, safety, and dignity  of border residents at risk by stopping ambulances and patrolling through health centers in violation of their own policy.

The principle of fundamental fairness for all–one of our most cherished values–is enshrined in both the U.S. Constitution and international law. In many American Communities, however, Border Patrol agents treat residents the encounter as “guilty until proven innocent” in the community they call home.

This by no means is a surprise to me and others that believe that when it comes to immigrants rights since they have been largly ignored for years and because they have been used and abused in so many ways that for generations the rich become richer off the undocumented and at the same time their has been unfactual information about the affects of the undocumented , or all immigrants for that matter , that these unfactual statements have been passed on for years that in the minds of most citizens they are a threat to their way of life . And this is so embedded into the minds of people that just by seeing a person that looks like “THEY ARE NOT LEGAL ” they then become a target . This is only the beginning of their struggle to become excepted into this country and given fair treatment . The way I see this is we have ignored this issue for too long . While I realize their has been some laws changed in their favor but its nothing if during all of this nothing changes with these people that still feel they have power over them to treat them inhumanly and then to suffer no consequences for their actions . This first needs to change
